BOXIT Terms and Conditions
Notice
When ordering through BOXIT’s services, you, as the “Shipper”, agree on your behalf and on behalf of anyone else with an interest in the shipment, that the Terms and Conditions shall apply from the time BOXIT accepts the shipment unless otherwise agreed in writing by an authorized officer of BOXIT.
- Shipment refers to all documents or parcels that travel under one waybill and may be carried by any means BOXIT chooses, including air, road, or other carriers.
- A waybill includes any label produced by BOXIT automated systems, waybill, or consignment note and incorporates these Terms and Conditions.
- Every shipment is transported on a limited liability basis as provided herein. Shippers requiring greater protection may arrange insurance at an additional cost (see details below).
- BOXIT refers to any member of the BOXIT network.
Customs, Import, and Exports
BOXIT may perform the following activities on the Shipper's behalf to provide its services:
- Completing documents, amending product/service codes, and paying duties or taxes required under applicable laws and regulations.
- Acting as the Shipper's forwarding agent for customs and export control purposes and as the Receiver for designating a customs broker to perform clearance.
- Redirecting the shipment to the Receiver’s import broker or other address upon request by any authorized person.
Unacceptable Shipments
Shipper agrees that shipments are unacceptable if:
- They are classified as hazardous material, dangerous goods, prohibited/restricted articles by IATA, ICAO, ADR, or any applicable government or organization.
- No customs declaration is made when required.
- They contain prohibited items such as counterfeit goods, animals, currency, weapons, human remains, pornography, or illegal drugs.
- BOXIT determines they cannot be carried safely or legally.
- Packing is defective or inadequate for transportation.
Deliveries and Undeliverables
- Shipments cannot be delivered to PO Boxes or Postal Codes.
- Deliveries are made to the address provided by the Shipper but not necessarily to the named Receiver personally.
- If the shipment is unacceptable, undervalued for customs purposes, or if the Receiver refuses delivery, BOXIT may:
- Return the shipment at the Shipper's cost.
- Dispose of or sell the shipment without liability, applying proceeds to service charges.
Inspection
BOXIT reserves the right to open and inspect shipments without notice.
Shipment Charges
- Charges are calculated based on the higher of actual or volumetric weight.
- BOXIT may re-weigh and re-measure shipments to confirm calculations.
- The Shipper is responsible for paying shipment charges, duties, taxes, and related costs incurred by BOXIT.
BOXIT Liability
BOXIT’s liability is strictly limited to:
- Direct loss and damage only.
- Liability limits:
- USD $10.00/kilogram for air or non-road transport.
- USD $5.00/kilogram for road transport.
- Claims are limited to one per shipment and considered final upon settlement.
Time Limits for Claims
All claims must be submitted in writing within 30 days of BOXIT accepting the shipment. Otherwise, BOXIT shall have no liability.
Shipment Insurance
- BOXIT offers optional insurance to cover the shipment's actual cash value against loss or physical damage.
- Insurance must be requested via BOXIT systems and does not cover indirect loss or delays.
Delayed Shipments and Money-Back Guarantee
- BOXIT strives to adhere to delivery schedules but is not liable for delays.
- Certain services may include a money-back guarantee, with details available on the BOXIT website or through customer service.
Circumstances Beyond BOXIT’s Control
BOXIT is not liable for loss or damage caused by:
- Electrical or magnetic damage to data or recordings.
- Shipment defects or characteristics.
- Acts of third parties, customs, or government officials.
- Force majeure events (e.g., natural disasters, wars, industrial actions).
International Conventions
- Shipments by air involving other countries are governed by the Warsaw or Montreal Conventions.
- International road transport may be subject to the Convention for International Carriage of Goods by Road (CMR).
Shipper’s Warranties and Indemnity
The Shipper warrants that:
- All provided information is accurate.
- Shipments are prepared securely by reliable staff.
- Shipments are properly marked, addressed, and packed.
- All laws and regulations have been followed.
Shippers indemnify BOXIT against loss or damage due to non-compliance.
Routing
Shippers agree to all routing and diversions, including intermediate stops, as determined by BOXIT.
Governing Law
Disputes are subject to the non-exclusive jurisdiction of the shipment’s country of origin and its laws.
Severability
If any provision is invalid or unenforceable, the remainder of these Terms and Conditions shall remain effective.
